GST fight to the High Court

The WA Liberal Party are planning a High Court challenge in an attempt to get our State a bigger GST share.

Former State Treasurer Mike Nahan is planning on the move under section 99 of the Constitution which bans the Commonwealth from giving preference to one State over another.

George Williams is a constitutional lawyer and told 6PR Breakfast, “there is a big obstacle in the way and that’s because the High Court has looked at this once before back in 1926 and what it said then is that section 99 doesn’t limit what the Commonwealth does when it gives out money to the States.”
