Leading Perth KC Tom Percy believes it will be impossible for Bruce Lehrmann to receive a fair trial after the entire jury in his rape trial was discharged after a juror brought research material into the jury room.

Mr Lehrmann is accused of raping Brittany Higgins in Parliament House in 2019. He has pleaded not guilty to sexual intercourse without consent.

“We always fear as defence lawyers, or even prosecution lawyers, that jurors might go home at night and start doing their own research, which is independent of the evidence, and use that to shape their view … that’s not allowed,” Percy told 6PR Mornings host Liam Bartlett.

“The evidence that gets into court is pure and it’s legal and that’s why jurors should only rely on that.”
