Legally, they do have land rights. Unless they formally cede these rights these rights are not extinguished. The Convention on the Rights of Indigenous Peoples does not permit for rights to be exthinguished without agreement. In terms of Heirrison Island, even by Crown Land legislation Customary Rights are not extinguished and are to be respected. How about some civil discussions? Mr Edwards has said we will respect their laws and we will respect their laws - this is a paradox. The issues should be focused on - Native Title tribunals have failed Aboriginal peoples - The Final Ord River Agreement has not resolved the myriad issues peoples face why then will this Native Title proposal do any good - the offer is the equivalent of the value of several city buildings for extinguishing all present and future rights for a limited bundle of rights - and hence inter-generational poverty exists. This is not about land but about peoples' lives.
